Changes Opium Act (Growshop Act)

10 marijuana seeds maximum per customer
In the light of the changing legislation we decided to change our policy with respect to the purchase of marijuana seeds. In several online sections of the legislation 200 plants is mentioned as being the difference between hobby and professional cultivation. Though marijuana seeds are excluded from List 2 of the Opium Act, we think it is advisable to hold on to a maximum of 10 seeds per customer.

To make clear that we want to stay far away from professional cultivation, we decided to maximize the sale to 10 marijuana seeds per customer. This way, the hobby cultivator is still able to cultivate several (medicinal) plants of weed without any facilitation of punishable acts by Dutch-headshop. The cannabis seeds are exclusively meant for collectors.

When you would like to order more than 10 seeds, you will not be able to complete the order. It is not allowed to buy several cannabis seeds in a short amount of time. Would this accidentally happen, then the order will be canceled or changed anyhow.

Product assortment for hobby
Our whole product assortment is adapted to the new Opium Act, also called the Growshop Act. We exclusively sell for personal use, purchases for large scale or professional cultivation will be refused.

We only and exclusively sell products for the small-scale hobby grower at home in small numbers. This means exclusively small amounts, volumes and allowed products that are not on the indicator list of Annex 1 "Designation Opium Act". It is not allowed to realize several purchases in a short amount of time.

If you order large amount of volumes anyhow, then then the order will be canceled or changed. If we suspect that there is an intention for illegal use of our products, we will refuse the order.

In these terms and conditions the following terms are used in the following manner unless explicitly stated otherwise.

Dutch-Headshop: the party that determines the terms and conditions.

The customer: the counterparty: an institution or a natural person.

1. These terms and conditions are valid for all offers, quotations and contracts between Dutch-Headshop and the customer, on which Dutch-Headshop has decided them to be applicable and in as far as the parties aren’t deviating from these terms and conditions, as has been explicitly expressed in writing.

2. The following terms and conditions are also applicable to the contracts with Dutch-Headshop in case a third party is involved in its execution.

3. Possible deviations from these terms and conditions are only valid in case they have been explicitly agreed upon in writing.

By placing an order personal data are recorded in the administration of Dutch-Headshop. By written request customers can view their recorded personal data. Corrections, as communicated by the customer, will be processed unless these corrections appear to be incorrect.
Dutch-Headshop will not provide personal data to third parties in case the customer’s privacy is thereby damaged other than for legal reasons or purposes of registration of personal data.

Offered products are represented and/or described – in written offers and/or on the webiste –  as clearly and truthfully as possible and possess the qualities that are mentioned by Dutch-Headshop in the offer. The website clearly states the purchase amount and the rights and obligations of the customer, should he decide to accept the offer.

All prices on the website are including 21% VAT, excluding shipping costs and possible reimbursement costs.

Dutch-Headshop only ships the goods after having received the payment unless the customer has chosen for a reimbursement. Dutch-Headshop conceed themselves the right to refuse orders or to process the order at a later date.

All products bought from us come with a statutory warranty. This means that a product must be in good condition and should perform properly when used. If you receive a product that does not fulfil this requirement then we will provide you with a repair, a replacement or a refund depending on the product.

In addition to the statutory warranty, certain products come with a manufacturer’s warranty which is an extra guarantee provided by the manufacturer or importer. More information on the manufacturer can be found in the product documentation.

If you send a product for repair, you will not receive a replacement. We will do our best to repair your product within the given repair time and send it back to you in full working order.
If you complain about a faulty product, it can be repaired if the defect is not caused by: damage by intent or negligence, misuse or improper maintenance, normal wear and / or damage by not observing the operating instructions. Glass components are not covered by the warranty.

Returning shipments/products:
An approval period of seven days applies to all purchases. Within the approval period the customer has the right to return the products in the original package without any commitment to purchase. Returned products cannot be either used or damaged. Also the customer has to live up to all conditions applicable to return shipments. Customers are responsible for the costs of a return shipment.

After receiving the return shipment and approval by Dutch-Headshop regarding the state of the products, reimbursement will take place within 14 days.

Delivery takes place after the payment has been received (within one working day after payment). Cash on delivery orders and orders paid by bank transfer are delivered directly (within one working day).

The final delivery time will never exceed the confirmed delivery time with more than one week unless in case of force majeure. In case the delivery term has been exceeded, the customer will need to express his claim to Dutch-Headshop in writing. Orders are shipped by PostNL or GLS. The customer pays for the shipping costs. The shipping costs are mentioned on the website under Shipping.

Dutch-Headshop assumes the responsibility for damage and loss of products during shipping. After the products have been received by the customer, the responsibility for damage and loss is carried over to the customer. In case one or more products are lost, the customer is obliged to cooperate in the investigation upon the first request thereto. In case of non-compliance with this request Dutch-Headshop can rightfully claim the purchase amount on the customer.

Already paid amounts for products that are returned within the approval period or advance payments will be reimbursed in accordance with the conditions as stipulated by Dutch-Headshop in case the sale doesn’t materialise.

Dutch-Headshop is based in the Netherlands and will adhere to Dutch law. In some countries or states importing, storing and possessing some products is illegal. In case you would like to order certain products, check the local (customs) rules and regulations. Dutch-Headshop doesn’t assume any responsibility for treading local (customs) rules and regulations.

We ship our products under the assumption that third parties won’t avail of them in a manner that is against the law. Dutch-Headshop does not want to encourage anybody to act against the law. We want to emphasise that anybody using our products is fully responsibly for their own future actions. Dutch-Headshop does not assume any responsibility in this respect.

Dutch-Headshop cannot be held accountable for damage as a result of improper or unlawful use of the purchased products.

Dutch-Headshop cannot be held accountable in the event of confiscation by customs authorities in case the rules or laws of your country or state have been violated. In that case you cannot demand a reimbursement.

This website and our products are intended for people of over 18 years old. No sales to minors, only adults! Keep all products of Dutch-Headshop away from children.
